Therefore you and or your staff (paralegal(s)) needs to research the type of crime your client is being accused of to see if there are any prior cases similar to the charges that are being brought about your client. Once you find cases similar to your case, the first item to look for is the result of the case guilty or not guilty, original charges filed or lesser charges determined by the jury. Appropriate defenses are developed by determining what made the cases defense or set it up for failure. Was there any or enough evidence? Once you find the pieces you need you will then entice your research of the pieces to benefit your clients’ defense. The criminal defense used in the felony case I chose apparently was battered wife defense. In researching the term battered wife defense I found various definitions but the most descriptive info I found was as follows, Battered woman syndrome describes a pattern of psychological and behavioral symptoms found in women living in battering relationships. People v. Romero, 13 Cal Rptr 2d 332, 336 (Cal App 2d Dist. 1992); See Walker, L., The Battered Woman Syndrome (1984) p. 95-97. There are four general characteristics of the syndrome: 1. The woman believes that the violence was her fault. 2. The woman has an inability to place the responsibility for the violence elsewhere. 3. The woman fears for her life and/or her childrens lives. 4. The woman has an irrational belief that the abuser is omnipresent and omniscient. According to www.dictionary.com, omnipresent means present everywhere at the same time. Omniscient means having complete or unlimited knowledge, awareness, or understanding; perceiving all things. â€Å"Apparently battered womans syndrome has been used in criminal cases since the late 1970s. Experts must qualify to testify on this syndrome as they must in any other case.† (divorcenet.com/states/oregon/or_art02). The defense developed in the case was appropriate due to the fact that Dixie Shanahan had been abused for years on end even though it would come and go in spurts. I don’t think there could or would be more appropriate defense per her case accept for maybe temporary insanity. I actually can see both sides of it though. When reviewing the description of the assignment it says that she went directly to the closet got the gun shot him dead blank then wrapped his body and closed off the room for a year. Per her defense she said that he already had the gun and she got a hold of it more or less. In any event she was in fear of her life and the lives of her children. What ever happened at that moment, she pulled the trigger. She is guilty of murder or voluntary manslaughter. Being that I have been in a similar situation, seeing my mother battered for the first seven years if my life as a child and also being the target of that abuse here and there myself during those seven years I can understand that fear. My mother lost what would have been my twin brothers due to being knocked down a flight of stairs. Six years later, I saw my mother and my now step father almost murdered in front of my 7 year old eyes. If I hadn’t made a sound that made them stop then me and my little sister and brother may have been with out the parents that raised us. Luckily, they didn’t see me, but I had caused enough ruckuses to make them run from the scene of the crime they had just committed. My mother never knew that I had seen everything being that I was too afraid to tell her. As a result of that night, we moved to a different state. I couldn’t see the whites of my mothers’ eyes for almost 2 years because they were solid red due to the blows that she had received from a 24 board. After 3 years of being on the run away from the psycho my parents decided to move back to our home state. I started having major seizures again (being epileptic) and apparently I started acting out. I finally told my mother that I had seen everything. I actually feel guilt for that sometimes because I could have been a witness against them yet as a child fear totally took over. Being that I saw so much and also experienced physical abuse as a child I can understand why the Dixie did what she did and why the citizens of her community and the governor gave her leniency. Due to what I experienced and witnessed I am a very head strong person and I can say with no guilt that I would do the same thing if I was as weak as her and had gotten to my limit as did she. Though being as head strong as I am due to experiencing what I did experience, I would leave the first time around if a man ever tried to do to me what my mother and Dixie experienced. With all the laws we have today pertaining to spousal abuse and bodily harm in general no one can say that there is nothing that can be done for actions that occur in that mannerism. A case I found that was quite similar to the one I chose for this project was the recent case of Mary Winkler, the wife of the Tennessee Minister Matthew Winkler, who was at the time the minister of the Fourth Street Church of Christ in Selmer, Tennessee. It is almost a duplicate situation of Dixie Shanahan’s case. She was continuously physically, mentally and sexually abused. All of which lead to her a point that she could not handle it anymore. She admitted to getting the gun yet claimed that she thought it didn’t have a bullet in it. She shot her husband from behind in the back. Yet, she plead insanity was convicted of voluntary manslaughter and released in august of this year from a mental institution. She didn’t even get half of the time that Dixie got. (cnn.com/2007/US/law/09/12/winkler.oprah/index.html). As you can see as time goes on changes happen. Even years prior to Dixie’s case she could have gotten the death penalty, though she did n’t. It all depends upon the time of the crime, how and where the crime occurred and last but not least the minds of the jury, how they see your situation evidence or no evidence it is the jury that makes the final decision. Communication I believe it is important to have a pre-shift meeting with the supervisors and run through what is planned for the day. Any concerns are raised prior to the start of the shift, so we have a clear direction of how we are going to achieve these goals. I try to keep meetings informative, constructive yet light and brisk. I feel it is important that we start the day with a can-do attitude. It is important to me that the delivery of any communication is clear, precise and accurate. Communication works two ways and I feel that we only learn by listening. I operate an open door policy, where any member of staff at any level can speak to me. Encouraging growth of people and business I want to encourage growth within the company; in order to do this I develop people by encouraging them to learn new skills and keep up-to-date with processes on the line. The rotation of staff within the production line not only benefits the operator with skills and self worth but also protects the company when manning levels are low. Control of production is constantly developing and shifts with new products, technology and tools. Clear instruction is given to staff to embrace and use these as a way forward for the success of the company and maintain our position as leaders in the world market. Following policies I follow the company policies in all aspects of my work and with discipline. I feel I am firm but fair; I nip things in the bud and deal with conflict in a calm, mature and professional manner. I am trustworthy and always deal with matters with integrity. Respect Respect plays an important role in getting results from staff. I respect everyone and work hard to earn respect from my staff by being a team player and not taking my role for granted. I have worked on every process on each line to different skill levels and am aware of the requirements of each job. I would never expect any member of staff to complete a task I would not do myself. Understanding customers It is important to understand the expectations of customers, to achieve these within the budget and on time. In order to achieve this we work closely to a plan, delivering on time and in full (OTIF). Feedback It is important that recognition is given on a regular basis to staff that are doing well and like wise, support is given to staff who find things a struggle. It is easier to rectify any non-conformance at the very beginning than letting bad habits form. The ability to explain things that are incorrect and how to rectify them is an important management quality. Resolving issues Whenever a major problem comes to light, I tend to bring key skilled personnel such as quality facilitators, department manager, shift manager, manufacturing supervisors, process engineers, fitters, electricians or operators into a brain storming session. We utilise the skills we have developed and use management tools such as, the ‘Ishikawa diagram’, or known to myself as the ‘Fishbone diagram’. Each personnel would have a valuable input using the knowledge that they have obtained from their own perspective. Conclusion Throughout this essay I have explored the use of what are in my opinion, the most important skills to have as a manager. Many cultures categorize their society according to wealth, power, education, religion, ethnicity and occupation. These differences usually draw the lines that not all are willing to cross for different reasons. In America, the consequences when crossing classes are usually implemented by an individual’s family and peers. If a person decides to date or marry someone of a lower class, the immediate concern would be if the person of a lower class is interested for monetary gain whereas, the person of a lower class may be concerned if they would be treated as an equal in the relationship. With these problems present the courtship or marriage could be domed from the beginning or made to work harder at leveling the playing field. I believe love in lower class groups build their foundation on love where relationships are concerned simply because high expectations are not placed upon them and they are free to love whomever their hearts desire. In the marriage market, characteristics such as income, education and occupation are key definitive qualities when looking for a perspective life long companion. In addition, the tendency of individuals to marry others with similar traits has important implications for social inequality, income redistribution and education. However, there is still little understanding about what generates this assertive matching. One possibility is that people like to follow horizontal preferences when choosing a spouse to share similar characteristics of their own. This approach is believed to provide the security of longevity in love. However, sometimes people will experience an attraction to someone outside their social class whether it’s above or below but not always follow through due to fear of failure or rejection from family and peers. According to Karl Marx, one percent of the population is considered upper class and their wealth is generally inherited. Members of this particular class are perceived as snobs by the lower classes because they tend to look down at anyone outside their circle. This group does not have to work but often serve as board of directors of major companies and they are careful to only socialize with peers of an elite group. In most cases, parents with young children are thinking ahead as to who would be a good match and what social events to come would provide excellent choices of companionship. Their expectations would be for their children to select a person of equal or greater than the wealth of their own. In many cases, if a selection of a lower class is the choice of an immediate family member there would be great consequences including releasing them from all or most of the family’s wealth. Some would perceive the choice as rebellious and some may feel that it’s simply true love. If a person is made to feel that options are limited it may be an act of rebellious. However, if they stumble across a person they feel a connection with and is able to communicate on a level of satisfaction than the ability to proceed should be encouraged. Too often, members of the upper class enter the union of marriage because it meet or exceed the expectation of family and peers and later become unhappy with their choice. When this happens, they are reluctant to free themselves in fear of what others would think. Women in most marriages of the upper class are unhappy because the husband is usually away from the home on extended stays for multiple reasons. To fill the void of their husbands’ temporary absenteeism, they will keep themselves busy with charities, hobbies and the children if they are not away in boarding school. Although the divorce rate is low for this class infidelity is high. Because this class is very much secluded from the others, persons on the outside believe they must be happy in love assuming the problems of the lower class would not be an issue due to their wealth. In fact, many of the same problems exist such as communication, loneliness and loyalty to name a few. However, the upper middle class makes up approximately ten percent of the U. S. population and are successful business people, executives and high ranking civil and military officials (Long 2010). This group acquires their wealth from investments, savings and little of their wealth is inherited. The possibility of marriage within these groups is very likely to have longevity, mostly because it is expected of them although happiness with their spouse may not last the duration of the union.

One obvious benefit is the ability for body to develop more efficiently than running on a flat surface. Another benefit is the increase of the heart rate. The heart rate increases because the activity is much more intense than running regularly or jogging.Jogging bleachers requires the exercise to be performed at a higher intensity. This type of workout helps to teach an individual’s cardiovascular system to recovery quickly. This is because after going up the bleachers and resting for a few seconds, the body needs to be ready to be able to work hard again once it is time to run back up. This workout is known as a cardiovascular exercise which is effective in burning calories.This helps to increase the body fat loss and allows the heart rate to elevate for at least 30 minutes. A big reason w hy most athletes run bleachers is because of its ability to increase leg power. In certain sports, such as basketball, soccer, football and track, leg power is necessary to better the performance of the player. Climbing up the bleacher requires the quadriceps and glute muscles in the legs to push off each step with force. Running bleachers also puts more of a variety into an average person’s workout.This prevents muscles from adapting and allows them to continue development. For runners, finding a set of bleachers to run can be considered a break from their same daily route, which will keep them from becoming tired. For those who are not runners, bleachers will most certainly help to work out the muscles throughout the legs. However the people still prefer MERU, due to its punctuality, readiness to go to any corner of the city and overall customer service. Though I feel 60% is too high. According to me MERU is 5 to 10% costlier than normal taxis So the consumer will pay you premium, provided you make him feel that he is getting value for money Compensation Every company feels that they are paying the best to their employees and every employee feels that he is underpaid. However in case of MERU, the employee pays the company and both are happy. I will explain briefly the MERU model MERU hires the driver with certain driving experience and train him on soft skills. ?A contract is signed between MERU and the driver. ?MERU buys the car and gives it to the driver ?The fuel cost has to be borne by the driver ?The maintenance of the car is taken care by MERU ?MERU helps the drivers by providing the booking to drivers through their call centers ? The driver is free to take fares if he doesn’t get the fare from the call center ? In return the driver provides Rs. 800 per day to MERU ?Whatever the driver earns above these 800 rupees is his own income. As per him Easy Cabs tried to replicate the MERU’s business model, however they are not very successful. He told that Easy Cabs have 400 cabs, whereas MERU has close to 1700 cabs. Easy Cabs drivers have to pay 900 rupees to Easy Cabs and also bear the cost of fuel as well as maintenance of the vehicles. Whereas in MERU the driver have to pay 800 rupees and the company bears the cost of maintenance. This shows how much Mishraji believed in his company. The point which I am trying to drive here is that the employee should believe in the management the company for it to succeed, i. e. walk the talk. So if one gets these things right for a business, it can lead to a successful business. Satisfaction with the romantic image of rocket building can buoy many engineers through the highly anonymous work environments that many of them face. Internships, summer jobs, and any experience in the field are helpful, as entry into this industry is highly competitive. Discrimination and Stereotyping

Prejudice, stereotype and discrimination are merely against for anyone for any reasons as they were defined(Rand, Sowell, & Epstein, 2007). Prejudice, a feeling based not a belief based, is referred to as unconstructive judgment or opinion figured out lacking familiarity and knowledge on facts. It is only a feeling based on assumptions without considering any prior facts about the group being prejudge. Prejudice is often based on stereotype. One great cause of prejudice is the differences on skills, talents, beliefs and experience even though sometimes these differences benefit us.For an instance, on social classes, we feel wealthy classes are said to be superior to any other classes in society. Stereotype is referred to conventional opinion as any mental image of social group regardless of individual differences. At some point, stereotype can also be seen in positive outlook, for an instance the stereotype for Asian Americans being good in the field of Mathematics. Stereotype is som etimes the foundation of prejudice. Discrimination being known to as prejudice in action, it referred to as the unlikely treatment for other people in terms of race, culture or religion.An example is the discrimination on African Americans due to their color, treating them unequally from the White Americans(Educators, 2006). Prejudice, stereotype and discriminations have some negative impacts on the society as they may are said to be harmful behaviors. It may lead to limitations of opportunities for people who said to be of lesser standard than others (Phone, 2007). The limitations may be of many cases like in popularity, achieving no equal rights to gain popularity. In employment and promotion, only those think and believe to be capable of the job were brought in to employment and get promoted.In having rights and power, like the black who does not have equal privileges as white ones. The Scenerio Prejudice, stereotype and discrimination on the scenario or case of Elizabeth who is a second-grade school teacher is exemplified. There exists discrimination when he only praises Walt than Ricky, just because Ricky comes from a lower class society and on the other hand Walt from middle class, Elizabeth provides not equal treatment as should praise both of them when answers correctly and should giving a helping hand for both of the students whenever they commit mistake which was merely opposite to the scenario.The action done by Elizabeth is the harmful behavior of discrimination. She shows no favorable response for Ricky being in the lower class. Stereotypically speaking, the scenario shows stereotype behavior because Elizabeth believes that Walt has greater knowledge the Ricky. Elizabeth may be in doubt of Ricky’s intelligence that is why she does have not significant time praising him and helping him and not giving equal chances for both students to show what they have got..And also the prejudice behavior relates with stereotype, while Elizabeth believes n ot for Ricky’s capabilities, she does a pre judgment that maybe Ricky will took hard time to cope up even though it is only his opinion. And that opinion may lead to hasty generalization or wrong generalization. The scenario or case being tackled is only one of those situations that involve prejudice, stereotype and discrimination. The case may affect both students, Walt and Ricky, but in opposite and much different manner. For Walt, it may be a positive effect on him for instance that he may live a world with praises which can help him develop self esteem.On the other hand, Ricky might suffer fear of interacting with other people of different class with him. He may become a victim of limitations from opportunities as one of the main result of prejudice, stereotype and discrimination. He might also lose his privilege and freedom to learn and also his right as a child to new more about his world and surroundings. Implicit Association Test In connection with prejudice, stereoty pe and discrimination, I took the Implicit Association Test. This test shows whether I had hidden biases towards different people. In the IAT, I took the Weapons (‘Weapons – Harmless Objects' IAT) .An IAT which require the ability to recognize White and Black faces and associate them with images of weapons or harmless objects. The result of my test was your data suggest a slight association of Black Americans with Weapons compared to White Americans (corp. , 2007). The result dictates that I slightly relate harmful objects with Black Americans which I think not necessary true to myself. Maybe the pressure of doing the test with time limit also affects the result because of my eagerness to finish the test. I don’t consider Black Americans as harmful people and so I assume that the research tool was not accurate.The Implicit Association test is I can say a not reliable or accurate tool to be used. Many things could affect the result, it can be affected by being rig ht handed or left handed either. The key we are able to press most likely just conform to our most used hand or finger. Another one was the pressure on time, where it is also stated there that we just need to press the right key in a short time. Even though as I have said not accurate tool to used, It is only matters for the reason the it is an interesting and enjoying tool for us to know about our hidden biases on different races, culture or religion.
